SRINAGAR: The High Court of Indian illegally occupied Jammu and Kashmir (IIOJK) has quashed the illegal detention of three youth who were held under the draconian Public Safety Act (PSA). The court’s decision came after hearing three separate petitions challenging the detention orders, and it directed the authorities to release the trio immediately.
The individuals identified as Muyeeb Shafi Ganie, Mohammad Ayaz alias Shantoo, and Irfan Amin Butt had been detained by the district magistrates on April 7, 2022, May 5, 2023, and May 2, 2023, respectively. The charges against them included alleged involvement in anti-India and pro-freedom activities.
The quashing of these PSA detention orders reflects a legal intervention aimed at safeguarding the rights of individuals in IIOJK, where such preventive detention laws have been widely criticized for their misuse and impact on civil liberties. The High Court’s decision underscores the importance of upholding due process and ensuring that individuals are not subjected to arbitrary and unlawful detentions.
As the region grapples with political tensions and longstanding issues, legal proceedings like these play a crucial role in addressing concerns related to human rights and judicial fairness. The court’s stance in this case aligns with broader discussions surrounding civil liberties, dissent, and the rule of law in conflict-ridden territories, emphasizing the significance of transparent and accountable legal processes.
