LHC Likely to Take up Governor’s Plea Against Elections in 90 Days Today

LAHORE: The Lahore High Court is likely to take up today the intra-court appeal filed by governor Punjab Baligur Rehman against the decision of single judge-bench for holding the elections for the provincial assembly elections within 90 days.

Governor Punjab, Balighur Rehman had challenged the LHC’s decision to hold elections in the province within 90 days on Thursday. Punjab governor through his counsel filed an intra-court appeal against the Lahore High Court’s single bench ruling. A two-judge Lahore HC bench will take up governor’s appeal today after he requested an early hearing.

Last week, while hearing a petition filed by the Pakistan Tehreek-e-Insaf, the Lahore High Court had directed the Election Commission of Pakistan to hold elections for the provincial assembly within 90 days. In its order, the Lahore High Court had directed the Election Commission of Pakistan to “immediately” announce a date of the elections after consultations with the Punjab Governor, who is the constitutional head of the province, to ensure that the elections are held not later than 90 days as per the mandate of the Constitution.

In line with the Lahore High Court order, a three-member Election Commission of Pakistan delegation called on the governor on Tuesday last but the meeting remained inconclusive. During the meeting, the governor was of the opinion that so he was not under any constitutional obligation to announce the date of the elections as he had not dissolved the assembly. The governor said that the court’s decision requires an explanation for which they were taking the legal route.
