LHC: Petition Seeks Implementation of Official Secrets Act Stayed

LAHORE: A petition has been filed in the Lahore High Court seeking a stay order against the implementation of the Official Secrets (Amendment) Act, 2023, following President Arif Alvi’s Sunday statement, saying he never signed the Official Secrets and Army Act into law.

The application was filed by advocate Muhammad Muqsit Saleem and parties include the federal government and the interior ministry.

The petitioner took the stand that President Arif Alvi had stated that he had not signed the Official Secrets Act. He added that the law was not adopted according to the procedure.

The lawsuit urged the court to declare the law suspended pending a final ruling.

The Petitioner further stated that the Official Secrets (Amendment) Act is unconstitutional and asked the court to hold Sections 2, 4 and 11 of the Act unconstitutional and declare it invalid.

The court should order the suspension of the implementation of the law pending a final decision.

Meanwhile, a special court was created under the Official Secrets (Amendment) Act and its additional charges were vested in a judge of the Accountability Court.
