ISLAMABAD: A local court in Islamabad on Friday dismissed a petition challenging the nikah — which was “solemnized against Sharia” — between former prime minister Imran Khan, and Bushra Bibi on Friday.

Muhammad Hanif, the petitioner, had filed the court seeking legal action against the Pakistan Tehreek-e-Insaf Chairman for marrying his present wife against Sharia and Muslim norms. Hanif had claimed that Imran Khan had married Bushra Bibi despite her ‘iddat’ period not having ended and stated that it is “against Sharia and Muslim norms.” However, he withdrew his case, leading to its dismissal.

In his latest application submitted to the court, the petitioner stated: “For the time being, the applicant wants to withdraw the above complaint due to technical reasons.”

“If permission to withdraw the complaint is not accorded, the applicant shall suffer irreparable loss.”

Considering the statement of the complainant, Judicial Magistrate (East) Qudrat Ullah granted permission for the withdrawal of the complaint under Section 248 of the Code of Criminal Procedure (CrPC) and closed the case.

Imran Khan-Bushra Bibi Marriage Case

The petitioner had claimed that Bushra Bibi was divorced by her ex-husband in November 2017 and married to the PTI Chief on January 1, 2018.

The complainant submitted in the court the statements of Mufti Muhammad Saeed — who conducted the marriage between Imran and Bushra, and Awn Chaudhry — Imran’s close friend — one of the witnesses at the wedding.

In his statement to a lower court, Saeed said he had solemnized Khan’s nikah with Bushra Bibi on January 1, 2018, over the assurance of a woman claiming to be the former first lady’s sister.

In his statement, he said that Imran Khan contacted him again in February 2018 and requested him to solemnize his nikah again, as the first nikah with Bushra Bibi was against Shariah.

He said that the first time when the nikah was solemnized, Bushra Bibi’s Iddat hadn’t ended.
