PTI Moves Supreme Court Against Imran Khan’s Conviction in Toshakhana Case

ISLAMABAD: The Pakistan Tehreek-e-Insaf (PTI) on Monday submitted a plea to the Supreme Court, urging it to declare the verdict rendered by Additional and Sessions Judge Humayun Dilawar against Imran Khan in the Toshakhana case as “null and void.”

The petition, lodged under Article 184(2) of the Constitution, seeks a fresh hearing of the Toshakhana case on the grounds that former Prime Minister Imran Khan did not receive a fair trial.

The petition stated, “Mr. Imran Khan, the former Prime Minister of Pakistan, has been denied a fundamental right under Article 10A, The Right to a Fair Trial, in relation to his conviction in the Toshakhana case.”

Imran Khan was apprehended and transferred to Attock Jail on August 5 following his conviction by the district and sessions court in the federal capital. The conviction pertained to alleged corrupt practices linked to the state gift depository, allegations which Khan vehemently denies.

Imran Khan Awarded Three-Year Imprisonment

Additional and Sessions Judge Humayun Dilawar handed down a three-year imprisonment sentence to Khan, accompanied by a fine of Rs100,000, and issued an immediate arrest warrant.

The PTI’s petition contends that the judgment was delivered hastily and in Khan’s absence, contravening the directives of the Islamabad High Court (IHC).

The petition highlighted that the IHC’s order dated August 4, 2023, explicitly remanded the question of maintainability back to the learned Additional Sessions Judge, with instructions for a fresh determination.

“However, the Learned judge disregarded this directive, sidestepping any new deliberation and summarily dismissing the application in a rush, without a thorough and impartial assessment of the case, thereby undermining principles of natural justice,” the petition stated.

In a separate development earlier today, the PTI approached the IHC, requesting the relocation of Imran Khan to Adiala Jail and the provision of enhanced or A-Class facilities. The party argued that Khan is accustomed to a higher standard of living.
